Migrant Advocates Sue Biden for Limiting Asylum at the Border

Migrant advocacy groups, including the powerful American Civil Liberties Union, ACLU, filed a lawsuit Wednesday against the US administration’s president, Joe Biden, for the decree restricting asylum on the border with Mexico.

“By enacting an asylum ban that is legally indistinguishable from the Trump ban that we successfully blocked, we had no choice but to file this lawsuit,” said attorney and ACLU leader Lee Gelernt.

The activist said that the Biden government lacks unilateral authority to annul Congress and prohibit asylum based on how one enters the country, a point that the courts made very clear when the administration of the former republican president.

Meanwhile, the directive of the Immigrant Defense Center of the Americas, Jennifer Babaie, expressed in the same text that «Asylum is not a legal loophole, but rather a life-saving measure, access to asylum is a human right and legally protected in the United States».

According to the executive order signed by Biden, the border with Mexico must be closed to migrants seeking asylum when there are more than 2,500 irregular crossings in the average of seven days.

In addition, the decree tightens standards for examining asylum applications and encourages expedited deportations.

This includes exceptions such as unaccompanied minors, victims of «a serious form of trafficking», migrants with a visa and those who arrive at a port of entry through a legal route such as the CBP One mobile application.
