Restoration of Family Migrant Detention in the U.S. Under Future Trump Administration

The decision by U.S. magnate Donald Trump to restore the detention of migrant families faces legal restrictions, as a federal judge prohibited the separation of migrant families at the border for a period of eight years at the end of 2023.

Amid a hardening rhetoric against people arriving from other nations, Tom Homan, in charge of immigration policy under the future Trump administration, announced on Friday that this measure will be implemented starting January 20.

During an interview, Homan indicated that the restoration will include the construction of new facilities to house detained families. “The number of beds we will need will depend on what the data indicates,” he added.

Homan, who also served as director of Immigration and Customs Enforcement (ICE), emphasized that the government will not consider the citizenship status of minors born in the United States, even if they hold U.S. nationality.

“The problem is this: you knew you were in the country illegally and decided to have a child. So it was you who put your family in that position,” he stated.

In 2021, President Joe Biden’s administration closed detention centers for migrant families. During Trump’s administration, specifically under the “zero tolerance” policy in 2018, many migrant families were separated; adults entering the country illegally could be prosecuted while their children were placed into social services.

This new measure could reignite controversies over the treatment and conditions faced by migrant families in the United States.
