A Maryland man, Kilmar Ábrego García, was wrongfully deported to an infamous prison in El Salvador, where he faced a serious risk of persecution. Federal Judge Paula Xinis has ordered his repatriation by the end of the day, but the incident makes it clear that current immigration policies are not only flawed but dangerous.
Ábrego García was expelled by Immigration and Customs Enforcement (ICE) despite an immigration judge ruling in 2019 that he should not be deported due to the threats he would face in his home country, where local gangs pose a constant danger. Judge Xinis called the deportation “an unlawful act” and expressed frustration at the lack of answers from Department of Justice attorney Erez Reuveni, who admitted his client should never have been removed.

Additionally, the government has attempted to discredit Ábrego García by labeling him as a member of the MS-13 gang, based on unfounded claims from a confidential informant. However, his lawyers have argued that there is no concrete evidence supporting this accusation. This tactic is not only irresponsible but also reflects a misuse of power against vulnerable individuals.
